TUPE or the Transfer of Undertakings (Protection of Employment Regulations 2006) applies to organisations of all sizes and protects employee rights when the organisation or service they work is transferred to a new employer.

According to TUPE, the employees of an outgoing employer automatically become employees of the incoming employer. They should continue to work under the same terms and conditions of employment with the new employer.

The outgoing employment must provide the new employer with Employee Liability Information, that is to say the information about the employees being transferred. This information must be provided no less than twenty-eight days before the transfer.

It is unfair to dismiss an employee before or after a transfer solely or mainly because of the transfer. Moreover, if an employee believes that the terms and conditions of their employment contract have considerably changed to their detriment prior to or after a transfer, are entitled to terminate their employment and claim constructive unfair dismissal.
