Workplace bullying is often characterised by offensive, intimidating or insulting behaviour that seeks to undermine, denigrate or humiliate the recipient. There can be a fine line between innocent banter and more serious behaviour. It can be made against an individual by another individual, potentially by someone in a position of authority, or by a group.

Employers are legally responsible for preventing bullying in the workplace. If the employer fails to do so, in certain circumstances the employee may be able to resign and claim constructive dismissal at an Employment Tribunal on the basis of breach of contract, as long as they have worked for the employer for the qualifying period in order to bring such a claim. It is always prudent to take legal advice before taking the decision to actually resign.
